- Goof (factual errors): SPOILER: Grand juries don't actually work as depicted in this episode. Generally speaking, a judge is normally at most an advisor to a grand jury; the grand jury itself makes the decision on whether to formally charge a suspect. Specifically under Oregon law, a felony suspect is given either a preliminary hearing before a judge or a deliberation by a grand jury. If the grand jury deliberates, the judge is not involved and may not override their decision, and the testimony and deliberations are not public. If the suspect gets a hearing instead, the grand jury is not convened at all, and both prosecution and defense have the right to present testimony, which the judge cannot block. Oregon law does not provide any opportunity for a judge to arbitrarily dismiss an uncharged felony suspect without any testimony presented.
